Abstract: OSHA is hereby extending the partial administrative stay of therevised final standards for occupational exposure to asbestos,tremolite, anthophyllite, and actinolite for general industry (29CFR 1910.1001) and construction (29 CFR 1926.58), insofar as theyapply to occupational exposure to non-asbestiform tremolite,anthophyllite and actinolite. The current partial stay, originallyset to expire on 4/21/ 87 and extended until 8/31/91 is beingfurther extended until 2/28/92 to allow OSHA to completesupplemental rulemaking limited to the issue of whethernon-asbestiform tremolite, anthophyllite and actinolite shouldcontinue to be regulated in the same standard as asbestos, or shouldbe treated in some other way. OSHA also is making minor conformingamendments to notes to the affected standards. The changes merelyreference the extension of the stay and restate the applicability ofthe 1972 standard. OSHA finds that advance notice and opportunityfor comment are impractical and unnecessary in view of the limitedduration of the extension and the continued applicability of the1972 standard (29 CFR 1910.1001) to cover the gaps in coveragecreated by the partial stay. Effective Date: 8/30/91. |
